Once the User Submissions are submitted to our website or through social media managed by 2Quench Cafe, the submissions become the property of 2Quench Cafe. 2Quench Cafe does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and 2Quench Cafe expressly disclaims any and all liability in connection with User Submissions. 2Quench Cafe does not permit copyright infringing activities and infringement of intellectual property rights on its website, and 2Quench Cafe will block and remove all content and User Submissions if properly notified that such content or User Submission infringes on another’s intellectual property rights. 2Quench Cafe reserves the right to remove content and User Submissions without prior notice.

Delivery Surcharge

2Quench Cafe operates in defined geographic territory boundaries. 2Quench Cafe endeavors to offer delivery to all customers, however, this is not always possible due to geographical or access constraints. If you live in the delivery region you will be notified of this during your online order and you can choose whether to have your order delivered, and such delivery will attract a surcharge of $5.00 – $15.00 depending on the distance from the shipping location. Minimum order spends of $30.00 (AU) applies to all delivery orders. 2Quench Cafe provides team members wages that are among the highest in the industry, including penalty rates as per the Restaurant Industry Award (Modern Award). 2Quench Cafe will not be liable to you for any loss or damage (whether direct, indirect, or consequential) as a result of a change in a store’s delivery boundaries.

Refunds

If you did not love your meal, then please let us know within 24 hours. We will replace or refund your order and make sure that your next experience with us is a great one!

Please be aware that while we do everything from our end to complete this refund as soon as possible, it may take up to 3-10 business days for the refund to be processed, depending on your financial institution and the transaction type (ie Credit card, Debit card, Paypal).

After 24 hours it would be difficult to trace down the issue and 2Quench Cafe will not be responsible for a refund.

Online Ordering via the website, Applications ordering

If the website, application, or an electronic device is used (including for online ordering), you are responsible for maintaining the confidentiality of your personal details, password (if applicable), and payment details. You acknowledge that when you access the website or an application as a  registered member, you may remain logged in to the website or application even after closing the internet browser or application (unless you log out prior to leaving the website/application, or you erase or block Cookies from the electronic device used to access the website (refer to our Privacy Policy for more information on Cookies)). Where an online order is placed using a smartwatch, your session will time out after 60 minutes of inactivity (provided that you have not selected the ‘keep me logged in’ option on your registered online account).

  3. Indemnify 2Quench Cafe from all claims, losses, judgment, liability, and damage relating to a failure of the online ordering system.

Steps we can take against your 2Quench Cafe Online Ordering Account

If:

  2. We think that your password or account has been compromised.

We may choose to take one or more of the following steps against your 2Quench Cafe Online Ordering Account:

Most 2Quench Cafe gift vouchers and Coupons contain a code that can be redeemed via the 2Quench Cafe online ordering system. Please note that 2Quench Cafe voucher codes are single-use codes and are only valid for redemption online; Coupons will not be valid for orders placed in a 2Quench Cafe Restaurant over the phone or in person. Voucher codes are not redeemable for cash or transferable.

2Quench Cafe reserves the right, in its sole discretion, to cancel any voucher code, or refuse to honor any voucher code (including after it has been redeemed by a customer), if 2Quench Cafe suspects that the voucher code has been fraudulently generated and/or circulated without 2Quench Cafe authorization.

2Quench Cafe Online Members

By joining 2Quench Cafe online, members will receive marketing communication by email in addition to service messages related to your participation in 2Quench Cafe online members.

Online Members may also receive a reward coupon code, which they can redeem for their next online order.

Online Member may also receive Birthday emails. To activate this discount coupon, you will have to bring a proof of age ID (which shows your DOB) as well as show us the email that you have received from us and you will have to book a table in advance, via online or over the phone.

REWARDS / POINTS

• • At its sole discretion, 2Quench Cafe may update a member account with a reward as a consequence of purchasing behavior, incentive, and/or promotional activities.
  • 2Quench Cafe will notify the member via email of their entitlement to any rewards.
  • 2Quench Cafe reserves the right to withdraw, cancel or vary the rewards without prior notice and at any time.
  • Rewards cannot be sold, transferred, or assigned and are not redeemable for cash or any other like cheques and credit notes.
  • Rewards can only be redeemed at the 2Quench Cafe website (https://2quench.com); 2Quench Cafe does not ship outside Australia.
  • 2Quench Cafe reserves the right in its absolute discretion to exclude certain items and promotions from being redeemed using rewards.

  • 2Quench Cafe cannot redeem members’ rewards on behalf of its members.
  • Returns: If the member wishes to return a purchase that has previously earned a reward, 2Quench Cafe will process the return and forfeit any loyalty rewards earned on the initial transaction purchase.
  • Exchanges: If the member wishes to exchange a purchase that has previously earned a reward, and the exchange is for a product of lesser value than the initial purchase, 2Quench Cafe will forfeit any loyalty rewards earned on the initial transaction purchase.

Allergen-free, Gluten-free, vegan, vegetarian (not limited to) Products

2Quench Cafe will endeavor in providing requests for a certain type of food (e.g. Gluten-free, Vegan, etc.) We cannot guarantee that this will be taken care of at all times, especially during the busy period.

Subject to law, 2Quench Cafe will not be liable for any costs, fees, claims, damages, charges whatsoever, including medical and dental costs, if a customer has any adverse reaction (including dental damage) to a product sold through a 2Quench Cafe.

We accept AUD (Australian Dollar) only and are inclusive of GST.

We accept VISA, MC, and AMEX cards (with a Minimum amount of $15 AUD).

LIMITATION OF LIABILITY

To the extent permitted by law, 2Quench Cafe liability in relation to any product or service purchased as a consequence of your use of this website is limited to the lesser of: (a) the replacement of any product purchased, and (b) the purchase price paid by you to 2Quench Cafe for the product or service.

To the maximum extent permitted by law, we will not be liable to you for any loss or damage (whether direct, indirect, or consequential) howsoever caused, nor will we be in default under these Terms & Conditions of Use, for failure to observe or perform any of our obligations under these Terms and Conditions of Use for any reason or cause except if caused by our gross negligence. If a jurisdiction does not allow the exclusion or limitation of liability in accordance with this paragraph but allows a limitation of a certain maximum extent, then our liability is limited to that extent.

INDEMNITY

You agree to defend, indemnify and hold harmless 2Quench Cafe and related corporations, affiliates, and the officers, directors, employees, and agents of these entities, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising from or in connection with: (i) your use of and access to the website (including any online ordering and applications); (ii) your violation of any term of these Terms & Conditions of Use; and (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; (iv) any claim that one of your  User Submissions caused damage to a third party; and (v) use of the User Submissions by 2Quench Cafe.

ABILITY TO ACCEPT TERMS & CONDITIONS OF USE

These Terms & Conditions of Use shall be governed by the laws of New South Wales, Australia. Any claim or dispute between you and 2Quench Cafe that arises in whole or in part from the 2Quench Cafe website shall be decided exclusively by a court of competent jurisdiction located in Wollongong, New South Wales. These Terms & Conditions of Use, together with the 2Quench Cafe website Privacy Policy and any other legal notices published by 2Quench Cafe on the website, shall constitute the entire agreement between you and 2Quench Cafe concerning the website.

If any provision of these Terms & Conditions of Service or Privacy Policy is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms & Conditions of Service and/or Privacy Policy as applicable, which shall remain in full force and effect.
